A Pembroke man who stabbed a neighbour in a dispute about a noisy kite has been jailed for 16 months.Kevin Mello, 38, who admitted wounding Joshua Madeiros last December, will also have to serve two years of probation when he is released.Under the conditions of the probation, Mello will submit to random drug tests and abstain from alcohol and other intoxicants.Puisne Judge Charles-Etta Simmons also sentenced Mello to one year in prison for threatening to kill Peter Clark and four months for stalking Laura Trott in 2017.Mrs Justice Simmons said Mello’s actions were “over the top, excessive and unreasonable”, and caused in part by his untreated schizophrenia.She added: “You know the difference between right and wrong or you would have been dealt with very differently in this court.”The Supreme Court heard the 2017 offences both stemmed from an altercation Mello had at a private event held at Cosmopolitan nightclub.In February of that year, Mello, who was employed by the club as a bouncer, clashed with a security guard hired by the event’s organiser.After the incident, Mello sent Ms Trott, the event organiser, a deluge of messages demanding the name of the security guard who he had the confrontation with.In the messages he threated to slash the security guard’s face and promised to “get revenge on anyone involved”. He then began to make “slanderous” posts on public Facebook pages, insulting Ms Trott and her business.The court heard that Mr Clark messaged Mello about the posts and threats — and on August 9, Mello threatened to kill Mr Clark and slash his throat in further posts.In a victim impact statement, Mr Clark said Mello later used Facebook to make contact with both his wife and daughter to make similar threats.Mello was arrested and charged for the offences and was released on bail.On December 18, 2018, while Mello was still on bail, he was arrested after a violent clash with Mr Madeiros.The court heard Mr Madeiros, described as a “kite enthusiast” and a neighbour of Mello, put up a kite with a noisemaking “hummer”.Mello, who had made repeated complaints about the noise caused by Mr Madeiros’s kites in the past, began to throw rocks at the kite.Mr Madeiros approached Mello to confront him but the defendant lashed out and stabbed Mr Madeiros twice in the shoulder with a white-handled kitchen knife.Cindy Clarke, the Deputy Director of Public Prosecutions, had suggested a 20-month sentence for Mello for the attack.Charles Richardson, the lawyer for Mello, said Mello’s mental-health condition meant a prolonged prison sentence could do more harm than good.Mello apologised for his actions on Wednesday. He told the court: “I have learnt my lesson. It shouldn’t happen any more.”Mrs Justice Simmons said Mello’s untreated mental condition went “a long way” to explain his actions and that it was surprising that he had not been before the court for similar offences previously.She also noted his guilty plea and his willingness to receive treatment, adding that he had not attempted to shift the blame on to the victims.Mrs Justice Simmons ordered that all three sentences run concurrently, and that the nine months Mello has already spent in custody be taken into account.• It is The Royal Gazette’s policy not to allow comments on stories regarding court cases.
